With respect to Cuba, Tom helped organize, at the University of California at Berkeley, “A Dialogue with Cuba”, the largest joint U.S./Cuban academic conference on Cuba ever held in the United States, and, in 2009, he organized a benefit performance in Havana  by world renowned pianist, Idil Biret, with Cuba’s National Symphony.  He also represents, pro bono, scores of U.S. citizens being prosecuted in the United States for exercising their Constitutional right to travel to Cuba, including outspoken piano tuner, Ben Treuhaft, whose organization, Send A Piana to Havana, has had numerous run-ins with the United States Government donating pianos to Cuban churches and schools.Personal Injury:

Special Education Law:
Children with disabilities are protected by the Individuals with Disabilities Education Act 2004 (IDEA).  IDEA ensures that all types of services and programs are available to children who need them at no cost to the parent.  Unfortunately your child may not be receiving the necessary services from your school district and it is our job to ensure that your child has all services necessary to be successful academically.  We provide representation at no cost to you from its inception to the ultimate hearing.  In many of our cases our expertise has led us to obtain the necessary services for a child through mediation or negotiation but when a case requires it we will aggressively pursue litigation.  Contact us for a free consultation.

Mediation:
Miller and Ngo is a strong advocate for alternative dispute resolution. We are committed to finding fair and equitable solutions to our clients’ personal as well and legal issues. Mediation is cost effective, low risk, and an underutilized tool in solving disputes. Mediation involves the services of a well trained, certified, and neutral mediator, whose main goal is to assist opposing parties resolve their legal disputes without involving the time, expense and emotional wear and tear of litigation.
Mediation is generally a six step process. The first step is the introduction by  the mediator describing his or her role in the mediation process, and affirming the confidentially of the mediation. The second step is a statement of the problem by the parties, so that each side may give a brief and concise explanation of their problem. If either party desires, this can be done privately to the mediator, without the other party present, and the parties can remain in separate locations throughout the mediation.  The third step involves information gathering by the mediator, and sometimes the parties, to get a better sense of how he or she may help the parties come to an agreement. The fourth step involves a more precise identification of the problems and legal issues being presented by the parties. The fifth step involves bargaining and generating options for an agreement between the parties. The sixth and final step is reaching an agreement.
Oktober M. Miller is the firm’s mediator. He received training and certification while attending law school. During his training, Oktober worked as a pro bono volunteer in the Contra Costa  County Court, Small Claims Division, mediating contract, landlord-tenant, and civil harassment disputes.
Cuba and Vietnam:
Miller & Ngo has a special relationship with Cuba, Vietnam and Southeast Asia.  Founder and senior associate Tom Miller has had over 40 years experience in Vietnam, and over 15 years experience in Cuba.  He opened the first representative legal office in Vietnam after the U.S. embargo was lifted, and maintains a relationship with the only foreign law firm permitted to operate in Cuba.  He has represented numerous businesses with respect to both countries, and maintains excellent contacts.  He established the largest plastic and reconstructive surgery hospital in the world in Vietnam during the war to treat war injured children – a hospital that continues to this day as a teaching hospital. After the war he assisted in the release of both Americans and Vietnamese held as prisoners in Vietnam, and worked for the lifting of the embargo. In 2006 he co-founded the Vietnam Green Building Council, an independent non-profit organization in Hanoi which is establishing country-wide energy efficient green building standards to conserve energy, reduce global warming and adapt to increased sea levels and violent storms which are affecting Vietnam and the world. He is also active in the development of community based eco-tourism in Southeast Asia, as well as a project with Vietnamese scientists to convert algae into biofuel.   In Cambodia he is assisting in the protection of the largest tropical forest in Southeast Asia, which is rapidly being destroyed by illegal logging, mining and plantation clearing.
